Terms and Conditions of Sale
Intelligent Life (IL) is genuinely committed to excellence in customer service and aims to demonstrate this commitment in every facet of its relationship, including these Terms and Conditions of Sale. If you would like more information or clarity on any of the following, please don’t hesitate to ask. We would be only too happy to provide more detail, but please understand that the Terms and Conditions of Sale are not negotiable and will need to be accepted in their entirety.
DESIGN CONDITIONS AND DESIGN ZONES
Your system has been designed based on data supplied by the Australian Institute of Refrigeration, Air-conditioning and Heating. The data states that a ducted air-conditioning system should be sized for the following outdoor design conditions (the "design day"):
Perth
- Summer 36.6° C dry bulb (being the temperature without humidity) and 22.4°C wet bulb.
- Winter 7.4°C dry bulb.
Brisbane
- Summer 30.8° C dry bulb (being the temperature without humidity) and 24.9°C wet bulb.
- Winter 9.2°C dry bulb.
At the above design conditions, your air conditioning system has been designed to simultaneously maintain the following indoor zone temperature in the areas classified as design zones:
- Summer 24°C
- Winter 20°C
For the air conditioner to achieve better performance than what is outlined above, such as colder than 24°C during the defined summer conditions, or warmer than 20°C during the defined winter conditions, it will be necessary to reduce the area being conditioned. Similarly, in more extreme outdoor conditions than those defined above, it will be necessary to reduce the area being conditioned in order to maintain the same level of comfort. Please ask your consultant to explain this further if necessary.
The air conditioning requirements have been calculated based on the following assumptions:
- A minimum of R2.5 ceiling insulation has been laid flat on the ceiling.
- All curtains and blinds are drawn in the period of extreme temperature.
- All outside doors and windows are closed and internal doors are open to allow circulation to the Return Air Grille. (Under certain circumstances this may be less relevant such as with the implementation of Fresh Air , transfer grilles / ducts etc. – ask your consultant to elaborate if necessary)
- All areas are as per the house plans supplied for quoting purposes.
WORK OR COSTS EXCLUDED FROM THE QUOTE UNLESS OTHERWISE SPECIFIED:
- Upgrade to three phase power or power board upgrades.
- Any cost relating to the repair or replacement of exposed or unsafe wiring encountered during any part of the installation process.
- Installation of circuit breaker, mains cabling and isolator at the outdoor unit location.
- Repair of roof and ceilings if there is an existing system to be removed.
- In the event that roof repairs are undertaken by IL at the request of the client, in order to assist with the removal of an evaporative system, the replacement of roof sheeting or tiles is carried out with the greatest of care by IL, using the materials provided by the client. As IL is not a roofing company, however, it accepts no liability for any future leaks or water damage that may occur, and it is up to the client to decide if further repairs are necessary after completion of the job.
- Should ceiling repairs be undertaken by IL at the request of the client in the event that existing diffusers / filters are removed or require relocation, the repairs exclude paint.
- Building of bulkheads and suspended ceilings for the air-conditioning if required.
- Floor slab penetrations needed for the air-conditioning.
- Crane or hoist equipment costs are not included, but should IL be required to organise such equipment due to limited access, it will be done in consultation with the client and on-charged at cost.
- Any cost related to installing within or the removal of asbestos in walls, floors and ceilings. This includes, but is not limited to, making penetrations in asbestos or asbestos-like material, working in areas recently containing asbestos material or replacing outlets previously installed in surfaces containing asbestos.
- Any alterations required due to changes to the home, made by the client after the date of this quote.
- Underground pipe-work if necessary.
- Lath and Plaster Ceilings. No responsibility will be taken for any damage or repairs to Lath and Plaster ceilings. This is due to the type construction of these ceilings which your consultant can explain further. In the event that IL is required to cut into Lath and Plaster ceilings, a surcharge will apply. Your consultant will specify that this surcharge has been included in your quote, unless of course they are unaware of the presence of this type of ceiling. If it has not been specified in your quote, it will need to be added as a variation upon IL identifying this type of ceiling in your project. This may also restrict the selection of compatible diffusers / grilles that can be used in the installation.
Any of the above excluded work that is to be completed by the client or the client’s agents prior to installation, must be done in time to ensure that the installation can be done on schedule. In the event that this excluded work is not completed, or cannot be completed, and IL is not provided with reasonable notice in advance, then charges may be incurred, or the installation may be cancelled, and any costs incurred up until that date may be recovered from the client.
TERMINATION AND EXPIRY
The client demonstrates their acceptance of a quote by signing the quote and adhering to the deposit requirements outlined in the quote. IL reserves the right to re-calculate any quote that is not accepted by the client within 30 days of issue.
Whilst the sales consultants are extensively trained in air conditioning design and installation procedures, the following can only be confirmed during a site inspection by a qualified site supervisor or project manager (which only occurs after the quote has been accepted):
- the suitability of the product for installation in the home;
- the specific location of the products including the unit, diffusers and grilles; and
- the need for three phase or power board upgrades.
Should IL be unable to install the system as detailed in the quote due to factors such as, but not limited to:
- lack of required space for componentry and equipment;
- underestimated capacity requirements for acceptable performance;
- unavailability of suitable power;
- issues arising from restricted available unit location; and
- discontinuation of equipment;
then IL will use its best endeavours to provide an alternative solution in line with the client’s needs and budget.
If this alternative solution is not acceptable to the client, then IL agrees to refund the client’s deposit, less any reasonable deduction for costs incurred in good faith up until that date.
Under all other circumstances, the client’s deposit is non-refundable unless otherwise specified.
WARRANTY
The warranty for the system is:
- For the air-conditioning unit including compressor and condenser, 5 years.
- For the electronic controls, 5 years.
- For the components: duct, diffusers and other mechanical fittings, 10 years.
The warranty is for parts and labour. To make a warranty claim the client must:
- Have their IL invoice as proof of purchase.
- Have adequately annually serviced the system with a professional air-conditioning service provider.
The warranty does not include the cost of restoration or removal of any structure which is required to perform the warranty work, such as cutting access holes in ceilings where no access panel has been provided.
IL is not liable for any damage due to negligent use of the system by the client, for example not cleaning the Return Air Grille filter.
The client must lodge a claim for any problem, shortage, damage or fault in the installation within 30 days of the final commissioning.
DELIVERY
Existing Homes: IL will deliver the air conditioning system to the client’s installation address before the installation. The client may request details of the estimated delivery time from IL. The client will be responsible for the system once delivered, and IL will not be liable for any loss by the owner for the delivery not being made at the estimated time.
Homes Under Construction: IL is unable to accept responsibility for equipment after it has been installed on site. Any liability for damage, theft or vandalism to equipment installed on building sites is the responsibility of the client / builder.
INSTALLATION
Before the system is installed, the client or client’s builder is responsible for the following:
- Ensuring that the installation site is free of anything that may hinder the installation of the system.
- Ensuring that any excluded work that is the responsibility of the client is done - see “Work or costs excluded from the quote" above.
- Obtaining and paying for any approval required, including permits, from any government authority, including any Shire, necessary for the installation.
If any of these have not been done at the scheduled day of installation, Intelligent Life may be caused to cancel the installation and recover any costs until that date from the client.
If there is any delay in the installation for any reason, Intelligent Life is not responsible for any loss suffered by the client or anyone else. If the client wishes Intelligent Life to do any other work not specified in this agreement, a separate agreement needs to be drawn up for that work.
Whilst every precaution has been taken to protect your home, furniture and equipment from dust, we cannot guarantee this if "blow in" insulation has been used, or if there are lath and plaster ceilings.
PAYMENT
The client has the following options to pay for the system:
- Bank cheque (No personal or business cheques can be accepted)
- Credit card (VISA or MASTERCARD only) - which will incur a transaction fee of 1% of the transaction value.
- Electronic funds transfer being made before or during the commissioning of the system.
- Cash
Until full payment is received by IL, the client holds the system for IL and has a duty to care for the system and not use it. IL will retain the controls for the system until final payment has been verified. However, if the system is fully functional but one unimportant product is unavailable at the scheduled installation time e.g. a special order grille for one outlet, the client can choose to have the system commissioned and working for a payment that will bring the amount paid to 95% of the total price. The client retains 5% which is paid when the unavailable product is installed.
